Wireless Network Terms of Service

Effective Date: June 5, 2019

  1. The Guest Wireless Network Service.

    1. American Express Travel Related Services Company Inc. (“American Express”) provides a courtesy wireless Internet service (the “Service”) for guests of American Express Centurion Lounges.
    2. Use of the Service is entirely voluntary and at your own risk. If you have any concerns about the reliability, security or safety of the Service, you should not use it. If you use this Service, your use is governed by these American Express Centurion Lounge Wireless Network Terms of Service (the “Terms”). If you do not agree with these Terms, do not use the Service.
    3. American Express reserves the right to update these Terms at any time. Your use of the Service constitutes acceptance of the Terms current at that point in time.
    4. The Service is provided at American Express’ discretion and your access to it may be limited, withdrawn or changed at any time.

    IMPORTANT NOTICE
    Service Monitoring:
    American Express may track and monitor your use of the Service including logging the time you spend using the Service and sites you visit. We do this to ensure that all activities over the Service are appropriate and comply with these Terms (see Section 7 – Privacy & Service Monitoring for more information).

  2. Laws and Regulation. User access to and use of the wireless internet service is subject to all applicable international, federal, state and local laws and regulations.

  3. Restrictions on Use.

    1. The following is an illustrative, but not exhaustive, list of restrictions:

      1. Illegal Activity: Using the Service in a way that violates any applicable local, state, national or international laws, rules or regulations.
      2. Fraudulent Activity: Making fraudulent offers to sell or buy products, items, or services or to advance any type of financial scam such as, but not limited to, “pyramid schemes,” “Ponzi schemes,” unregistered sales of securities, securities fraud, and chain letters.
      3. Forgery or Impersonation: (i) Adding, removing or modifying identifying network, message, or article header information in an effort to deceive or mislead a third party or (ii) attempting to impersonate any person by using their name, image or likeness.
      4. Unsolicited Collection or Sharing of Personal Data: Collecting, disclosing or sharing a person’s personal information without their knowledge or consent.
      5. Threats and Harassment: Using the Service to threaten or harass another person.
      6. Objectionable Content: Accessing or sharing profane, bullying, obscene, discriminatory, sexually explicit, pornographic, derogatory, inflammatory, vulgar, violent, hateful, disrespectful, defamatory, or otherwise inappropriate, objectionable content.
      7. Intellectual Property Infringement: Using the Service in a way that infringes any copyright, trademark, patent, trade secret, or other proprietary rights of any third party.
      8. Disrupting the Network or Amex Systems: Using the Service in a way that adversely affects the ability of other people or systems to use the Service. This includes (i) excessive consumption of network or system resources whether intentional or unintentional, and (ii) “denial of service” attacks against another network host or individual user.
      9. Unauthorized Access: Using the Service to access, or attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of American Express’ its affiliates’ or another entity’s computer software or hardware, electronic communications system or telecommunications system to which you are not authorized to access or penetrate, as applicable whether or not the intrusion results in disruption of Service or the corruption or loss of data; or to monitor or attempt to monitor (through for example, sniffers) any network traffic, or to decrypt or attempt to decrypt any encrypted or scrambled third party communications.
      10. Non-traditional End User Activities: The Service is intended for a user’s periodic use of email, instant messaging, browsing the World Wide Web, and other typical uses while at a Centurion Lounge. High volume data transfers are prohibited. American Express maintains the right to terminate any user’s connection following the detection of any high volume data transfer, server hosting or other non-traditional end user activity as determined by American Express in its sole discretion.

    2. You acknowledge that American Express remains the sole and final arbiter of acceptable usage of the Service. American Express may take any one or more of the following actions, or other actions not listed, at its sole discretion in response to actual or perceived violations of these Terms by you: (a) issue written or verbal warning; (b) terminate your access; (c) terminate your invitation to the lounge; (d) bring legal action to enjoin violations and/or to collect damages, if any, caused by violations; or (e) report activity or suspected activity to law enforcement or other third parties.

  4. Disclaimer of Warranties. THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO WARRANTIES OF TITLE, MERCHANTABILITY, NON-INFRINGEMENT, OR FITNESS FOR A PARTICULAR PURPOSE WHICH ARE EXPRESSLY DISCLAIMED. YOU ASSUME ALL RISK FOR USE OF THE SERVICE. AMERICAN EXPRESS DOES NOT WARRANT THAT (A) YOUR USE OF THE SERVICE WILL MEET YOUR REQUIREMENTS; (B) THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR FREE FROM ERROR OR (C) THAT ANY INFORMATION OBTAINED BY YOU AS A RESULT OF YOUR USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

  5. Limitation of Liability. YOU ASSUME ALL RESPONSIBILITY AND RISK FOR USE OF THE SERVICE. AMERICAN EXPRESS IS NOT LIABLE, AND EXPRESSLY DISCLAIMS ANY LIABILITY FOR THE CONTENT OF ANY DATA TRANSFERRED EITHER TO, OR FROM, YOU OR STORED BY YOU VIA THE SERVICE. AMERICAN EXPRESS IS NOT RESPONSIBLE FOR ANY LOSSES, DAMAGES, COSTS OR EXPENSES YOU MAY SUFFER IN THE COURSE OF YOUR USE OF THE SERVICE; INCLUDING WITHOUT LIMITATION: PUNITIVE, EXEMPLARY, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES.

  6. Indemnification. YOU AGREE TO INDEMNIFY, DEFEND AND HOLD HARMLESS AMERICAN EXPRESS AND ITS PARENT, SUBSIDIARY AND AFFILIATED COMPANIES, THIRD PARTY SERVICE PROVIDERS AND EACH OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, SHAREHOLDERS AND AGENTS (EACH, AN “INDEMNIFIED PARTY”) FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, LOSSES, LIABILITIES, SUITS, ACTIONS, DEMANDS, PROCEEDINGS (WHETHER LEGAL OR ADMINISTRATIVE), AND EXPENSES (INCLUDING, BUT NOT LIMITED TO REASONABLE ATTORNEY’S FEES) THREATENED, ASSERTED, OR FILED BY A THIRD PARTY AGAINST ANY INDEMNIFIED PARTY ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE OR ANY VIOLATION BY YOU OF ANY OF THESE TERMS.

  7. Privacy & Service Monitoring. Your use of the Service is subject to our Privacy Statement.
